Discharge student loan??

will i be eligible to discharge my student loan????





heres my story,


I went to devry 3 years ago and they promise me that they can help me get approved on the student loan. During that time my green card was still in process. And then in the middle of 2nd semester they told me that they can’t do anything to help me get the loan because my green card was still on process. For that reason I just dropped out of school because I can’t pay my tuition fees. Then after a few months the collection agency started to call me asking them to pay my debt. I didn’t pay them because the school tricked me, they said that they can help me get the loan but they didn’t. Then a few more months they put my student loan in default.





I was just wondering if this situation will be qualified to discharge my student loan. I want to go back to school and get financial aid. I just got my green card 6 months ago.

you will have to prove that the school is at fault. you will need paperwork to back up your statements. i'm guessing there will be no promises in writing that they would secure your loan.


devry is a 'for profit' school. they don't receive government funds. they only make money through tuition. they charge much more than public universities but offer convenience in return. many of these 'for-profit' schools have been accused of less than friendly business practices.


it sounds like they sold you a bill of goods and then pulled the rug out. i'd get a lawyer if you really want to fight it but i don't think your chances will be too good.
Reply:From what I gather you didn't get approved for the loan , perhaps when they mention default they are referring to the inability to get one , Which would make you liable for the credit hours you did spend in school . I don't think you"ll be expected to pay back the amount of the loan request which would be much more. Contact the financial aide office at the school and ask them this question specifically , then you'll know the real score of where you stand in the matter. Good luck !
Reply:I hate to tell you this,but u messed up big time whem u let that loan go into default. I've been in college for three years and I went to two technical schools so I know all about loans and finantial aid. U should have told your story to the loan company and they probably would have defered your loan until you graduated like their doing mine. Now you will have to pay them. If you don't they will garnish your wages and take your inome taxesuntil the dept i paid. That's if it's a federal loan. I know this for a fact too because my sister went to school with me, but she didn't call to get her loan defered she just ignored them and let it go into default, now she's suffering for it. You really need to call that loan company and talk to them. Their the only ones who may be able to help you now, but once you let the loan go into default your options are very few.
Reply:By federal law, student loans cannot be discharged. The outstanding balance follows you until you die! If it is not paid by then, the government will deduct the money owed from your estate.





You need to talk with a loan counselor and get this matter settled. Since you haven't repaid the loan, interest and penalties have accrued. This means you now owe a lot more than the original amount you borrowed.





Denying that you are not responsible will not help. It is your responsibility to pay the loan. Three years have gone by and you are now considered delinquent. This will hurt your chances to obtain any credit in the future. No lender is going to give you a loan until you repay the student loan first.
