Student loans and Tax Rebate?

I have heard from several people that people with student loans through the government will not be receiving their tax rebate check. Instead of getting a check the $600 or $300 gets applied to the student loans. Does anyone know if this is correct?

Reply:Yes, it should be applied against the student loan.





The rebate payment will equal the amount of tax liability on the return (tax liability on the return Form 1040 line 46 or Form 1040A line 28) with a minimum amount of $300 and a maximum amount of $600 for individuals.





IRS began the transfer economic stimulus payments from April 28, 2008, and many have already seen the payments in their bank accounts. Those who opted for direct deposit will be the first to get the rebate. Mailing of paper check will begin from May 16. Those with last two digits of SSN between 88 to 99 will get paper check after July 4, 2008.





Those who did not get full tax rebate this year, will get remaining money in 2009 when they file their 2008 return and qualify.

If you owe Child support, DMV fee's and any other


governmental charge until the debt is paid in full.





Sorry. But I tell my clients to look at it this way. It lowers the


amount that you owe to whomever.


I've had clients pay off child support and other fee's with their


refunds and are glad to rid themselves of the pain.
Reply:I know that they will take the money if you owe any back payments to them, whether they are for student loans or back taxes or back child support through the state. If all your federal payments are current though, they should just send you the check.
Reply:that will only happend if your loans are in default or delinquency. if you have any other tax burdens the rebate check would be applied to that first. just as if you were to win money in vegas. the gov't gets their cut first.
