If the student commits it the student would be at fault. If the instructor told you to do something illegal then he would be at fault. If you knew it to be illegal and still did it then you both would be at fault.
Reply:both could be cited,simple as that,the instructor could possible lose his license which of course would mean his job,It would still be up to the discretion of the officer.

Reply:Ignorance of the law is not an excuse. You must have an instruction or learner's permit before you start driving, which means you have passed the written test for your state. The instructor is there to monitor and to supervise your actions, not make decisions for you. If you screwed up, then it's your fault!

After all, you are a student - expect to make mistakes. That's why you are there, learning from the instructor.





The instructor has the control on the passenger side.





They take that kind of risk to teach when they sign up to become instructor. So, clearly it is instructor's fault, regarless whether he told you to do something and you did not do it etc. etc.. etc..


That kind of argument does not wash.





Ask any insurance co. they will tell you the same thing.





After you get your license, you do something wrong - then obviously it is your fault. You are not a student anymore.
